Your Rights Under Applicable State Consumer Privacy Laws:

In addition to the disclosures and rights provided in our general Privacy Policy, if you are a resident of Virginia, Tennessee (as of July 1, 2025) or Kentucky (as of Jan. 1, 2026), you can exercise certain additional rights as further described below regarding your personal data (If an "as of" date is noted, you can exercise these rights as of the date provided). Because Publix only operates in certain states, the privacy laws in other states may be inapplicable to us, but if you are a resident of another state and have any questions or concerns about your privacy rights, you are welcome to contact us as provided in our Privacy Policy.
Exercising your rights
If you are a resident of one of the above referenced states, you may submit the following requests with respect to your personal data. When you make a request, we will respond within forty-five days potentially subject to a forty-five day extension if needed. All requests will be processed as directed by the applicable privacy law and subject to applicable exceptions.
1. Access and Portability Request:
We will confirm whether Publix is processing your personal data, and provide you with a copy of the personal data requested by you, to the extent possible in a portable and readily usable format.
2. Correction Request:
We will endeavor to correct inaccuracies in your personal data, taking into account the nature of the personal data and the purposes of the processing of your personal data.
3. Deletion Request:
We will delete the personal data we hold about you as of the date of your request from our records and direct any Publix vendor that processes your personal data on Publix's behalf to do the same.
In some cases, deletion may be accomplished through de-identification and/or pseudonymization of the information.
Please note that there are certain requirements or limitations permitted by applicable law which may prevent us from accommodating your deletion request (in whole or in part). Additionally, please note that by choosing to delete your personal data, you may no longer receive any communications from Publix, Club Publix, or Publix Pharmacy and you may forfeit your perks, e-receipts, clipped digital coupons, shopping lists, and/or other information associated with your Club Publix account. If your account is deleted, you will be able to open a new account in the future, but you will not be able to tie the new account to the deleted account’s transactions or other information.
4. Opt-Out Requests:
We will opt you out of the following activities:
Third Party Targeted Advertising
Stop displaying advertisements to you based on personal data obtained from your activities over time and across nonaffiliated (i.e., non-Publix) websites or online applications to predict your preferences or interests.
Note that this does not limit
(i) advertisements based on activities within Publix's own websites, Publix's online applications, the context of your current search query, visit to a website, or online application;
(ii) advertisements directed to you in response to your request for information or feedback;
or (iii) the processing of personal data for measuring or reporting advertising performance, reach, or frequency.
Sale
Stop selling your personal data, if any, to third parties.
Profiling
Stop engaging in automated processing of your personal data to evaluate, analyze, or predict personal aspects related to your economic situation, health, personal preferences, interests, reliability, behavior, location, or movements in furtherance of decisions that produce legal or similarly significant effects concerning you.
Note that to opt out of third party sales and targeted advertising using tracking technologies on our website, you need to separately opt-out of such tools through our Privacy Request Center.
Non-Discrimination
We will not discriminate against you for exercising your rights. This generally means we will not deny you goods or services, charge different prices or rates, provide a different level of service or quality of goods, or suggest that you might receive a different price or level of quality for goods. However, if you ask us to delete or stop selling your data, it may impact your experience with us, and you may not be able to participate in certain programs or membership services which require usage of your personal data to function.
To exercise the privacy rights described above, please perform the following:
- For consumers that have a Club Publix account, please log into your account and then click "Your Privacy Choices."
- For consumers that do not have a Club Publix account, call 1-800-242-1227 and inform the representative, "I'd like to exercise my state data privacy rights."
Verifying Your Identity for Privacy Requests
We take the security of your personal data seriously. We will verify the identity of each person who attempts invoke a rights request (e.g., request to access personal data) to protect against fraudulent or unauthorized requests. We may verify your identity in multiple ways. If you have a Club Publix account, we may ask you to log into your account. If you are making your request by calling into Customer Care, you may be asked to provide some personal data about yourself to help us validate your identity.
We may also email or text a verification code to you in order to ensure you control the contact information you are including in a privacy request. If we can't verify your identity, we may not be able to process your request. That said, we will use reasonable efforts to authenticate you.
How Do You Process and Share My Personal Data?
Please refer to the Publix Privacy Policy for information regarding the categories of Personal Data we process, the purpose for such processing, and categories of third parties which receive your personal data.
How Do I Appeal a Decision Made Publix Related to a Rights Request?
Contact Customer Care by calling 1-800-242-1227 and informing the representative, "I'd like to appeal a decision to an exercise state consumer data privacy right." We will review any appeal and respond within the timeframe provided by applicable law.
If your appeal is denied, you may contact your attorney general’s office to lodge a complaint, including as applicable, the Virginia Attorney General at 1-800-552-9963; Tennessee Attorney General at (615) 741-3491; and Kentucky Attorney General at 888-432-9257.
