Publix may provide users with the opportunity to register for mobile alerts, special promotions, services, news, and other information (each a “Wireless Marketing Service”) delivered via text messaging and other wireless devices such as mobile phones. These Wireless Marketing Services are provided by Publix and/or its affiliates for Publix and are available with most mobile carriers.
Publix Wireless Marketing Services are only available to subscribers who reside in the United States and are at least eighteen (18) years old. These Wireless Marketing Services are subject to these Terms and Conditions, which may be modified from time to time, and are void where prohibited.
Users who wish to receive a Wireless Marketing Service are required to provide their consent to receive such Wireless Marketing Service from Publix, either by registering on Publix’s Website or via the users’ wireless devices as described below.
Specific Wireless Marketing Services Offered. The following is a list of the Wireless Marketing Services currently offered by Publix, along with their expected frequency:
- Mobile text alerts relating to At Season’s Peak (up to two (2) text messages per week).
Availability. Our Wireless Marketing Services may not be available in all geographic areas or work on all mobile or wireless devices. Mobile devices that can receive text messages (SMS Service) are generally able to receive text alerts, provided that you have a text messaging service plan from a participating wireless service provider. Of course, Publix will not be liable for any delays in the receipt of any Wireless Marketing Services or related messages, as delivery is subject to effective transmission from your carrier or network operator. Please contact your wireless provider if you have questions regarding your SMS service.
Currently, Publix Wireless Marketing Services are available on the following U.S. carriers: Aliant, Alltel, AT&T, Boost Mobile, Cellcom, Cellular South, Centennial, Cincinnati Bell, Dobson, East Kentucky Network, Immix Wireless, nTelos, Rural Cellular, Sprint, Suncom, T-Mobile, Telus, Union Telephone, US Cellular Corp, Verizon, Virgin Mobile and West Central Wireless. We are continually working to provide Wireless Marketing Services to additional carriers. Please check back later if you do not see your carrier on this list.
Personal Information. The personal information (“Personal Information”) requested as part of the online registration process may include a user's telephone number (or a wireless email address , but only if specifically requested by Publix), and the carrier's name. Additional information may be requested for specific Wireless Marketing Services, such as a user's preferences regarding goods or services, or other similar information. We may use this Personal Information to contact you and to provide the Wireless Marketing Services you request from us.
Security/Delivery. You should keep in mind that most wireless transmissions are not secured and there is a greater risk of an unknown third party's interception of messages or a user's Personal Information when using a wireless communications device. Therefore, if you choose to sign up for any Wireless Marketing Services, you agree that Publix will not be liable to you for damages caused by a third party’s interception of such items.
Potential Charges. Publix does not charge users for its Wireless Marketing Services. However, your carrier's standard message and data rates may apply. Charges may show up on your mobile bill or may be deducted from your prepaid account. Users that register for Publix's Wireless Marketing Services acknowledge and agree that they may be charged by their respective wireless carriers for all messages that the users send to or receive from Publix. Please contact your wireless carrier if you have any questions about your wireless service.
Under no circumstances will Publix or its affiliates be responsible for any wireless email or text messaging charges incurred by a user, whether directly by that user or by another person who has access, whether or not authorized, to the user's wireless device, telephone number, or email address.
Registration (Opt-in) Methods for Wireless Marketing Services. The following registration methods are provided for Publix's Wireless Marketing Services.
SMS Opt-in Method: In response to print, radio, television, Internet, or other promotional messages, users will be directed to send a specific word or code via a text message to a designated telephone number to register for the specific Wireless Marketing Service promoted. The user's voluntary submission of the designated word or code to Publix will mean that the user has freely and affirmatively granted permission to Publix to send text messages to him or her. Publix will confirm the user’s registration by sending a "Thank you" or other similar confirmation message.
Site Opt-in Method: In response to print, radio, television, Internet, or other promotional messages, users will be directed to the Publix Website or other designated website to register to receive the particular Wireless Marketing Service. The user must affirmatively consent to Publix's sending of wireless messages to his or her designated wireless device by submitting a telephone number (or wireless email address, only if requested by Publix) and by clicking the consent statement on the designated website’s registration page. The user must also agree to the Publix Website’s Privacy Policy and Terms of Use before the online registration process is completed.
Assistance. If you have any questions about your selected Wireless Marketing Service(s), reply "HELP” to any of our messages, text "HELP" followed by the applicable word or term that describes the particular Wireless Marketing Service (for example, “HELP ASP” for information relating to At Season’s Peak) to the designated telephone number or contact us at 1-xxx-xxx-xxxx.
Termination of/Change in Wireless Marketing Services by Publix. As noted above, each user understands, acknowledges and agrees that Publix may, in its sole discretion and without liability to any user, terminate or modify its offer of any specific Wireless Marketing Service or all Wireless Marketing Services at any time without advance notice. Publix may provide notice of terminations or changes in services on this Website.
Use of Information. Publix will not use a wireless telephone number, wireless or conventional Internet email address, or other Personal Information submitted for its Wireless Marketing Services for any other purpose but to provide the service requested, unless we provide advance notice of any other use. We will not share any Personal Information with advertisers or other third party marketers unless you opt-in to such disclosure. We will share Personal Information with the operational service providers that assist us in delivering these Wireless Marketing Services to you and with our affiliates.
